III. FOR WHICH PURPOSES DO WE PROCESS PERSONAL DATA AND WHAT IS THE LEGAL BASIS FOR SUCH?
Visiting our website
When you visit our website for solely informational purposes – that is, if you do not transmit other information to us – we collect only the personal information transmitted to us by your browser. This includes:
- Your system’s IP address,
- Date and time (incl. time zone) of your enquiry,
- Type, content and protocol version of your enquiry (which specific page has been viewed),
- Access status (HTTP status code) of our server,
- Size of our server answer in bytes,
- Website from which the enquiry originates (so-called ‘referrer’),
- Your user agent (type, version, operating system used) and the domain you viewed.
The listed data is required by us technically to display our website, guarantee that it is stable and secure, and to optimise our offering.
The legal basis is Art. 6(1) (f) GDPR, with our justified interest arising from the purposes named above.
We delete this data after seven days at the latest. Personal data beyond this is saved only if it is deleted or anonymised appropriately; for IP addresses, this takes place by shortening them consistent with data protection, for example.
Cookies
Cookies are small text files saved on your system providing certain information to us. When you access our website, we draw your attention to use of cookies by displaying a cookie notification, referring to this Privacy Policy. You can then consent to cookie use there too.
The legal basis for the use of the technically required cookies is Art. 6(1) (f) GDPR. Our justified interest in using technically required cookies enables us to offer you a functional and user-friendly website.
The legal basis is your consent to technically non-required cookies pursuant to Art. 6(1) (a) GDPR.
Contact Form
If you use our contact form, we will use the data that you provide to us to answer your request, whereat only a valid e-mail address is required and the other details are voluntary. Your data can be stored in a Customer Relationship Management system (‘CRM system’) or a comparable software.
Data processing for the purpose of contacting us is carried out on the basis of Art. 6(1) (b) GDPR if your request concerns the fulfilment of contractual obligations or the initiation of a contract. In other cases, the legal basis is Art. 6(1) (f) GDPR, with our justified interest arising from the purposes named above.
The personal data collected by us for the use of the contact form will be automatically deleted after your enquiry has been finally settled unless we are legally obliged to store it or we require the data for performance of the contract. In addition, you can object to processing at any time if the processing is carried out on the basis of a legitimate interest.
Email Address
f you contact us using the e-mail addresses we provide, we save the personal data you transmit to answer your enquiries. Your data can be stored in a Customer Relationship Management system (‘CRM system’) or a comparable software.
Log data is regularly generated as part of transporting and delivering the e-mail, which for example also contains the IP address of the e-mail server you use. This log data is necessary for our e-mail server to be operated properly and also serves as evidence for server problems or security incidents.
The legal basis is Art. 6(1) (f) GDPR, with our justified interest arising from the purposes named above. If your contact with us is aimed at concluding a contract or takes place as part of an existing contractual relationship, the legal basis is Art. 6(1) (b) GDPR.
The data is deleted when the enquiry has been fully processed if we are not duty bound to store the data or if we do not require the data to fulfil the contract. In addition, you can object to processing at any time if the processing is carried out on the basis of a legitimate interest. The log data is deleted from our e-mail server after seven days at the latest.
Applicant Data
If you send us your job application, we will process the data submitted to us to fulfil our (pre)contractual obligations within the application procedure. If your application is successful, we will process the data for the purpose of carrying out the employment relationship.
Legal bases are Art. 6(1) (b) GDPR and § 26 German Federal Data Protection Act. If you transmit special categories of personal data to us voluntarily, e.g. health data or religion, the legal basis is additionally Art. 9(2) (b) GDPR.
If your application is unsuccessful, we will delete your data after six months at the latest. The data is saved up until that point to answer any queries on the application proceedings and to fulfil our evidence duties from the Employer Act. If you withdraw your application, we will delete your data immediately.
Oxomi
To provide and manage marketing documents, we use the ‘OXOMI’ product by scireum GmbH. The legal base for using this product is our justified interest in conveniently integrating our marketing documents into our website according to Art. 6(1) (f) GDPR.
Pressebox
We integrate our press releases using iFrame by way of the ‘PresseBox’ product. The legal base for using this product is our justified interest in integrating our marketing documents into our website in a user-friendly manner according to Art. 6(1) (f) GDPR.
Google Services
This website uses the Google services as described in more detail below and provided by Google Ireland Limited (‘Google’), Gordon House, Barrow Street, Dublin 4, Ireland.
The information generated as part of using the services may be transmitted to a Google server in the USA and saved there. Google has had itself certified in accordance with the EU-US Data Privacy Framework so that a possible transmission of data to the USA as a third country is justified by the corresponding adequacy decision of the EU Commission. We have also concluded the current EU standard contractual clauses with Google as the legal basis for any transmission of data to a third country that may take place. Finally, we assume that your consent also covers the transmission of data to a third country. In this regard, we would like to point out that we do not know exactly how the data is processed by Google and who (e.g. including US authorities and secret services) accesses the data. Generally speaking, there is no adequate degree of data protection in the USA comparable to the GDPR, and the enforcement of your rights may be considerably more difficult. For this reason, risks cannot be absolutely precluded.
Google Analytics
This website uses Google Analytics, a web analysis service that uses cookies (text files saved on your device) to enable an analysis of how you use the website so that we can continuously improve our offerings and make them more interesting
We have activated IP anonymisation (“_anonymizeIp()”) on this website. This means that your IP address will be truncated by Google within the Member States of the European Union or other contractual states of the Treaty on the European Economic Area before it is forwarded to a third country. This truncation eliminates any personal references. Only in exceptional cases is the full IP address sent to and truncated on a Google server in the USA. Google uses this information to evaluate how the website is used in order to compile reports on the website activities and to render other services on our behalf related to website and internet usage
You can change your browser settings to prevent cookies from being stored; however, the provider draws your attention to the fact that, in these circumstances, you may find that you are unable to make full use of functions on the website. Further, you may prevent the collection of data generated through cookies (incl. your IP address) and related to the use of the website as well as the processing of such data by Google by downloading and installing the plugin under the following link: https://tools.google.com/dlpage/gaoptout?hl=en-GB
You can also click
deactivate Google Analytics
to place a so-called Analytics Opt Out cookie preventing Google Analytics from collecting data when this website is used in the future.
The legal basis for the usage of Google Analytics is your consent, and therefore Art. 6 (1) lit. a GDPR.
As part of Google Analytics, we use the Google Signals extension, which enables tracking across multiple end devices and records the demographic characteristics of the user. We only receive the analyses from Google in aggregated and anonymised form. Google merges the data of users who are logged into a Google account during use if the user has activated the "personalised advertising" option in their Google account. Google Signals is only used with IP anonymisation activated.
Google reCAPTCHA
This website uses the Google services particularised in the following, provided by Google Ireland Limited (‘Google’), Gordon House, Barrow Street, Dublin 4, Ireland.
The information generated through use of the services may be transmitted to a Google server in the USA and processed there.
For the cases in which personal data is transmitted to the USA, we have concluded EU standard contract clauses with Google.
On our website we use Google reCAPTCHA to ensure that entries are made by a natural person and not by machine or automated processing.
Your IP address and, if applicable, other data Google requires for the service reCAPTCHA are thereby sent to Google.
The legal basis for using Google Maps reCAPTCHA is Art. 6(1) (f) GDPR, with our legitimate interest arising from the purposes named.
Google Maps
We use the Google Maps service on this website. We are thus able to display interactive maps to you directly on the website, and enable you to use the Maps function conveniently.
When you visit our website, Google is informed that you have visited our website’s associated sub-page. The data collected when you visit our website is also transmitted. This takes place irrespective of whether Google provides a user account in which you are logged in, or whether no user account exists. If you are logged in to Google, your data is attributed directly to your account. If you do not want your data to be attributed to your Google profile, you must log out of Google before you click the button. Google saves your data as use profiles and uses such for purposes of advertising, market research and/or organising its website in a needs-based manner. Such an evaluation takes place in particular (even for users that are not logged in) to render such needs-based advertising and to inform other users of the social network about your activities on our website. You are entitled to object to these use profiles being compiled; to exercise this right, you need to contact Google.
The legal basis for the usage of Google Maps is your consent, and therefore Art. 6 (1) lit. a GDPR.
Google Ads
We use Google Ads to draw attention to our offerings with the aid of advertising means (e.g. adverts) on external websites and to measure the success of these advertising means. In doing so, we pursue the aim of showing you advertising that is relevant to you, improving the design of our website and achieving economic control of our advertising costs.
The advertising means are delivered by Google via so-called “ad servers”. For this purpose we use ad server cookies, which can be used to measure certain parameters for measuring success, such as the display of advertising means or user clicks. If you are directed to our website from a Google ad, Google will store a cookie on your device in order to be able to undertake the described evaluations.
We ourselves do not collect and process any personal data as part of the described advertising and evaluation measures. We only receive statistical evaluations from Google. Based on these evaluations, we can identify which of the utilised advertising measures are particularly effective. We do not receive any further data from usage of the advertising means; in particular, we cannot identify users on the basis of this information.
Based on the utilised advertising means, your browser automatically establishes a direct connection to Google's server. We have no influence on the scope and further usage of the data collected by Google. We therefore advise you as follows according to our knowledge at this time. Through the integration of Google Ads, Google is informed that you have accessed the corresponding part of our website or clicked one of our adverts. If you are registered with a Google service, Google can link the visit with your account. Even if you are not registered with Google or you have not logged in, it is possible that the provider will store your IP address and amalgamate it with other data.
The legal basis for the usage of Google Ads and the placement of cookies is your consent, and therefore Art. 6 (1) lit. a GDPR as well as Section 25 Art. 1 German Telecommunications Digital Services Data Protection Act (TDDDG).
Google Tag Manager
We use Google Tag Manager to integrate code snippets into our website, e.g. for tracking mechanisms. Google Tag Manager does not store any data itself. However, it may also collect personal data and pass it on to the analysis tools integrated with it.
The legal basis for the usage of Google Tag Manager is your consent, and therefore Art. 6 (1) lit. a GDPR.
Youtube Videos
We have embedded YouTube videos into our online offering that are saved on http://www.youtube.com and can be played directly from our website. Google provides this service.
The videos are all embedded in ‘privacy-enhanced mode’, meaning that no data about you as a user is transmitted to YouTube if you do not play the videos. The data described below is transmitted to YouTube, but not until you play the videos. We cannot influence this data transmission.
When you visit our website, YouTube is informed that you have visited our website’s associated sub-page. The data collected when you visit our website is also transmitted. This takes place irrespective of whether YouTube provides a user account in which you are logged in, or whether no user account exists. If you are logged in to YouTube, your data is attributed directly to your account. If you do not want your data to be attributed to your YouTube account, you must log out of YouTube before you click the button. YouTube saves your data as use profiles and uses such for purposes of advertising, market research and/or organising its website in a needs-based manner. Such an evaluation takes place in particular (even for users that are not logged in) to render such needs-based advertising and to inform other users of the social network about your activities on our website. You are entitled to object to these user profiles being compiled; to exercise this right, you need to contact YouTube.
The legal basis for the usage of YouTube videos is your consent, and therefore Art. 6 (1) lit. a GDPR.
IV. Social Media
We maintain presences on various social media platforms to advertise our products and services and as a point of contact for interested parties and customers.
Please note that when using social media platforms, your personal data may be transmitted to third countries, in particular to the USA, and that we do not know exactly how and for what purposes this data is processed by the social media platform providers. It can be assumed that the data will be used for creating user profiles and for advertising purposes. In third countries, i.e. countries outside the EU and in particular in the USA, the data privacy standards are frequently not comparable with GDPR standards. The enforcement of user rights is generally more difficult in these countries. Your data is usually comprehensively processed if you have an account with the respective social media platform and are logged in. More information about how your data is processed can be found in the privacy policy of the respective social media platform.
The legal basis is our legitimate interest in presenting our products and services in a contemporary manner as well as the provision of interaction and contact options in accordance with Art. 6(1) (f) GDPR. If you contact us for the purpose of initiating or concluding a contract, the legal basis is Art. 6(1) (b) GDPR. If you give your consent, the legal basis is Art. 6(1) (a) GDPR, whereby we assume that your consent also covers the transmission of your data to a third country.
